Indemnity Agreement for Gutsy Women’s Community
This Indemnity Agreement (the “Agreement”) is made and entered into as of 21 October 2026 by and between Gutsy (Pty) Ltd (registration number 2024/683273/07), trading as Gutsy (“Gutsy”), and the undersigned participant (“Participant”).

Acknowledgment of Risks: Participant acknowledges that participating in any hikes, events or transportation organized by Gutsy may involve inherent risks and dangers including but not limited to, bodily injury, property damage, and death. Participant understands and voluntarily assumes all such risks and dangers.

Release and Indemnification: In consideration for being allowed to participate in any hikes, events or transportation organized by Gutsy, Participant hereby releases and discharges Gutsy and its representatives from any and all liability for any loss, damage, injury or expense that Participant may suffer, or that Participant’s next of kin may suffer, as a result of Participant’s participation in any hikes, events or transportation organized by Gutsy, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

Covenant Not to Sue: Participant agrees not to sue Gutsy or its representatives for any loss, damage, injury or expense that Participant may suffer, or that Participant’s next of kin may suffer, as a result of Participant’s participation in any hikes, events or transportation organized by Gutsy, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

Indemnification: Participant agrees to indemnify and hold harmless Gutsy and its representatives from any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and court costs, arising from or in connection with Participant’s participation in any hikes, events or transportation organized by Gutsy, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be deemed severed from this Agreement and the remaining provisions shall continue in full force and effect.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa and/or the laws applicable in the jurisdictional territory of another area if the event is outside of South Africa.

Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or understandings, whether written or oral, relating to the subject matter of this Agreement.
